My husband was not paid for a month, it's legal?

My husband is employed. They didn't laid him off, or fired, they said that they are in the process of signing a contract, for work. "It will take 2-3 days." Since then, it's been a month. He is at home, and he did not get any money in the last for weeks. Is this legal? Can they do this? His income was the only one that the four of us have? Can he apply for unemployment? Thank you very much.

He is at home, I meant he is not working. He calls the office every day, and they keep telling him that they will start in a day or two, because they signed the contract but the owner doesn't want to start the job yet. So they are in "pending". I thought they should have paid him...somehow...if they want to keep him, no? Of course he is actively looking for work, but he is still employed by that company.

It is 100% illegal. Once they employed your husband , they are liable to pay him salary whether they give him work or not. If they do not give work, it is their fault.He is fully entitled for wages for the past 4 weeks and till they assign him work.
Please wait. If they do not pay, please report the matter to the labour department.

what do you mean "he is at home"?
Is he working every day? if not, how can you expect to get paid?

If he hasn't been working, he should have filed for unemployment 3+ weeks ago - do it now

Its illegal if he was not paid for time that he actually worked.

Its not illegal for them to cut his hours down to 0.

If his hours have been cut against his will through no fault of his own, he should qualify for unemployment if he is actively seeking employment elsewhere. Its definitely worth contacting your state unemployment office in your situation.

No, it is not legal. Yes, he should apply for unemployment if he is unemployed. Otherwise, ask the unemployment people who to call about the boss not paying him. They are required to pay within 24 hours of the scheduled pay date.
