I took a job with a company and signed on to make $42,000 base salary a yr. about 2 weeks ago we were told that it was going to hourly ($15.40) plus commison, that means working fulltime i will make $32,032 plus commision, in order to make up the rest of the money they took away i need to average around 80 sales a week(that is next to impossible,the old quota was 35 a week which was rarely met) any way they gave us about 5 weeks notice and i dont know if that is legal. Can they just change my pay like that if i signed on for $42,000??? thanks

unless you have a contract that states otherwise employers can change your rate of pay and schedule as needed.
the only laws concerning how much you must be paid are in reference to minimum wage. there are numerous sales positions that aren't even covered by overtime regulations.
if you feel the sales quota is unfair speak with management about your concerns.they may be willing to address the quota issue or change the commission amount. communicating with your employer in a professional manner is the only way to try and improve the situation. |

i would leave, as $10k is a lot of money to lose in your salary. you should fight it first, try and talk and get some answers but ultimately your only choice is to get a job that will be the salary you require. |

yes, as long as they did it across your position and not just to you. $10,000 is alot of money maybe you should think about finding a new job |

If they changed the position throughout the company than yes it is legal.
If they changed ONLY the agreement that you had with them, then you would have a good case. |
