Are the 'bumping rights' specifically spelled out in your employment contract? Are you in a union that gives you these 'bumping rights'. If you answered yes to either one of these questions, you may have legal recourse.

If not, you are probablly out of luck.

Depend on what country and the labour law is like where you live. Generally, you should consult with any labour protection department there is in your country and in such a case you might not even need a lawyer. I had dispute with my boss, of whom I believe incompetent. She got into the work about six months ago and start arguing with me and rearranging things that I had been managing for ten years. My staff started to resign one by one. I has a discussion with the Human Resource and indicated that I do not wish to continue to work and they compensate me in the frame work of labour law and plus. I would have gain more should I sue them for dependants' benefit but I rather go quickly and quietly and see how my new boss would handle the job.
I read the labour law myself, but fortunately I have in-laws being lawyer and attorney. Go for it. I got ten months plus provident.

Bumping rights usually come in a Union Contract - if that is true in your case you need to file a grievance with your union. Either way you also should get an employment attorney to represent you. An employment attorney can find out why you are not being allowed to bump and clarify if you have any re-call rights (bumping & recall usually go together).

Your state bar association can provide you with referrals to employment lawyers in your area. Good luck.
