So you don't have anything in writing.
You are out of luck. But hopefully you have learned a valuable lesson. Don't believe anything that you don't have in writing.

They gave you a promise, not a contract. You don't have a job until you have a job offer IN WRITING. If they reneged on a contract, you would have legal recourse, but as it stands, you got nothing. Next time be sure to get it in writing. |

No, you have no legal action available to you. And even if they had actually promoted you, not just told you they were going to, they could legally demote you back to the original job. |

I was promised by my supervisor to be appointed in a higher position after I got the qualification, and completed my three year in-service training. I completed my training on the year 2003. I am still in the entry grading since 2000. In the meantime my supervisor has retired who who wrote a letter to be promted to higher position. Can I still reffer the dispute to CCMA for Conciliation? |

I am appointed as an Industrial Relations Officer at my company. Last year there was a backlog of disciplinary inquiries, appeal cases,grievances and disputes outstanding and line management together with trade unions lodged complaints at the General Manager that HR personnel do not do their job. I was deployed to go and do the job. I reported to Production HR Manager for the whole year, and I did a great job whereby the HR Manager sent me a recognition e-mail for the good performance. During the end of the year my performance appraisal was done by my previous supervisor and therefore did not get annual salary increase for the 2011. Who should have done my performance appraisal? Can I reffer the dispute to CCMA conciliation for Unfair Labour Practice? |
