My last employer is taking me to court because EDD feels I am qualified. What do I do?

So I was fired. I wont go into the whole story. I applied for EDD and the people interviewed me and made a decision to grant me the Unemployment Insurance. Now this employer that fired me wants to appeal it because they believe I don't deserve the money. I don't understand why they would go through all this trouble of taking me to court when an EDD officer interviewed me and the employer, the week I claimed my benefits and decided that I should be granted the money. I had my chance to tell my story and I stuck to it and so did my last employer. My mom thinks I need a lawyer. I think I should just cancell my benefits and not deal with it because I've had to deal with this bull for over a year now. What should I do?

I was fired because I answered my phone in the back of the office because it was my mother. I haven't been unemployed for a year I had to deal with harassment and abuse from my co workers for a year. I've had to deal with this court thing for a month. I've been disciplined for attendance which got better when I switched my shift to graveyard. I supposedly used profane language with a supervisor. I used the word "***." I was written up for texting my mom when a co worker threw a phone at me because thats all they saw was wrong.


    




One Step Ahead
If you were fired, why? Did you steal something from the company? Were you catch using drugs or did you get into a fight with your supervisor? It makes a difference if you broke the company rules, or if your termination was not fair.

If you did something wrong, I can see why they don't want to pay you unemployment benefits. If you have been unemployed for over a year, there is some wrong with your background or job history.

Contact the one stop center aka Career center in your area. They have counselors that you can talk to and all type of job resources. No charge to you, classes, computers, fax machines, workshops, classes that you can take. They have job bulletins from all over the US.

Get a lawyer. Your employer is probably hoping you'll get frustrated and drop the case and they won't have to pay. It might be just a matter of getting a lawyer to take your case to get them to see that it's not going to just go away for them. it might not even get to court and they'll settle with you.
