This was all done in the restaurant where I work during business hours. He was told to stop because it made the employees uncomfortable, me in particular. He continued and pulled up several employees who have worked hard to overcome past mistakes, myself included. Is there anything I can do legally?

This is appallingly bad management, but I don't believe it's illegal in and of itself. The information being posted is in the public domain; employees could have access to it if they wished to pull it off the internet themselves.
However, if his actions are creating a hostile work environment for employees, you may have a case. Actions such as bullying, harassing, intimidating, threatening, etc. are considered harassment and depending on the frequency and severity of the conduct, could be illegal. Visit www.eeoc.gov or www.dol.gov for more on hostile work environments and laws pertaining to harassment, retaliation,e tc.
If he was "told to stop", who told him to do so? Does that person know that he is continuing to do this? If you have an HR person, district manager, or someone else who might be able to intervene, it would be appropriate to contact that person. Any responsible company wants to retain good employees, not allow a poor manager to harass them into leaving.

I cannot image that you can unless there is something in the employee handbook regarding internet usage that would keep him from being allowed to do this.
Look at the Smoking Gun. If anyone was going to get sued for doing something like this, they would have.
I would suggest sending something to HR stating that this makes for an uncomfortable work environment and ask if anything can be done about it. At least this way you have something in your file. That being said, your boss will know you have done it.
I would highly recommend that you attempt to deal with the embarrasment. It sounds like you are working to overcome your past, BUT it is still you past and it will always be there. Hopefully you will be able to learn to laugh at yourself in the future, it is the best way to survive.

Are you saying that he was showing mug shots of employees who served jail time or were arrested to other employee's purposely? Like "Hey come over here I want to show you something. Look at this person and this person?" Is he insane??? This is a wilful malice act. I'll even throw in there to cause harm to your character since the chances of your co-workers ever seeing these pictures would be a million to 1. I agree with other posters when they say this is public information, but this is a manager who is actually doing this during work hours and on company property to boot. I am sure his bosses would love to hear about this. YES! You would have grounds to pursue legal action. Contact an employment lawyer regarding this and try to get other employee's on board with this. Or you can go yourself for a free consultation. What an a**hole. I swear I don't know how some people pick there management. In freakin' credible. |

what he did is completely legal.. maybe unethical maybe in bad taste but you cant sue someone for showing other people PUBLIC INFORMATION. REDVELVET IS A REACTIONIST THAT HAS HER OWN PROBLEMS AND THINKS SHE KNOWS WHAT SHE IS TALKING ABOUT SHE NEEDS HELP

You don't explain what you mean by "mug shots." If these are public records, then the information is not private and you likely have no recourse against him legally. If these are "company files" then they are likely private and he screwed up big time. However - even if public information, you should absolutely contact corporate, in writing, and "write him up" for this behavior as this is not someone who should be in a management position. I would have fired him on the spot. |

Notify your owner, office manager, or what ever level is above the manager that this behavior is making you uncomfortable and you would like it to stop. There is nothing legal that says he can not post the photo's since it is public information, public records. But that doesn't make it ethical to do so. Sounds like he may be doing it to try and get people to quit and walk away because he has a personal issue with it. Go to the next level and let them know this is making people uncomfortable and you would like the photo's taken down and the talk about it to stop. That should put a stop to it. If nothing works you can try talking to the E.E.O.C. (Equal Employment Opportunity Commission) to see if it would qualify for filing a complaint with them or not. |
