A good lawyer could argue this one either way. If your paycheck is spelled the same as your contract and you are cashing the checks, does that make you a federal banks check fraud suspect? you can't have it both ways. I would ask my boss to redo the contract with correct spelling. Good luck. |

I believe the answer is "of course," as long as you can show that the contract refers to you, and not someone else. For example, if your name is "Sally Smithertonberg" and the contract states "Sally Smithertanberg," there is likely no doubt that it refers to you (particularly once you actually work there). On the other hand, if the contract refers to "Sandy Bergsdorf," it might be a bit harder (though not impossible) to show that the contract is about you. The legal question is did you and your employer enter into the employment contract intending it to refer to you. If so, it is irrelevant that your name is misspelled. |
