"in a complaints enquiry at work involving 2 employees, is it normal for both parties to be suspended during the investigation, or just the party the complaint is against? Additional Details Thankyou all for your help. Gail, I did take Jake T up on his offer and his advice was great. all witnesses statements were collected on thursday, and the hearing is on monday. My partner has secured another job 'just in case'
again, thanks to everyone who helped.

UK employment law requires employers to have a disciplinary procedure.
This means that any employee can lodge a complaint through that procedure and the employer must take the complaint seriously.
It depends on the nature of the allegation, but if it is of a behavioural nature rather than a performance nature, the employer may investigate under their disciplinary code and suspension of the accused may be appropriate. |

Yes it is. It gives the company time to investigate the complaint. There is less chance of either employees to get other members of staff to back them up or cover for them. |

It's PC these days to treat both parties in the same way. I.E. both Innocent/guilty until proven guilty/innocent. I don't agree with it but the company is protecting itself from being seen as unfair and which could result in one or both of the parties turning on them. |

It is not that normal.
It could happen if there counter allegations and the employer needs to investigate to work out who is telling the truth. |

I think you should be more worried about what is going to happen rather than "is it normal for both parties to have been suspended."
Employers suspend people on full pay to allow them to conduct a full and thorough investigation of which the outcome could be dismissal for your partner.
Your partner will soon be requested to attend a disciplinary hearing of which he will be able to answer any allegations made against him, he should be using this time to read the acas web pages and to make some notes witness names etc. which will help in putting his defense together, to save his job.
I would take Jake T up on his offer of help if i were you and start to think of who your partner could take in as a witness with him.
You must notify the company of who this person is when the disciplinary date and time has been set, but do not let your partner go in alone.
Get busy, good luck |

Most companies have a structure in place that expects an employee to approach the offender first on an informal level to try and resolve the problem.Simply reporting a problem without doing this is sometimes viewed as inappropriate and vindictive. If I was him,I would look for another job and if the issue is irrelevant,I would sue the company and the individual to help pay the mortgage.People think they are allowed to simply complain but do not realise that it must be substantiated. If the employer has over reacted then jackpot.Forget the mortgage, they are paying for my new holiday home in France. It's actually quite simple.Look for another job just in case but record everything and build a case against the employer and the individual involved. If it goes pear shaped, you are ready. If they say all is ok,still sue them for the embarrassment and humiliation because everyone knows and is talking about it. |

Without knowing the issue at hand, it is normal for both parties to be suspended if they have both violated a company policy. It obviously isn't bad enough for them to be terminated or maybe one of them is so well liked that the company feels like if they punish one and not the other, they can be taking sides, so they are both getting the same punishment. At least, thats kinda how it works where I am employed. Hope this helps. |
