My past emplolyer is appealing my unemployment benefits. Im ?

I have never filed for this benefits and have been working all my life for
the past 24 years. I have paid into the system and now when I need the
unemployment help its denied. It dosent seem right the employer you left can decide this, of course they dont want to pay.

Sorry to hear about that, and you're definitely not alone. My last job would never pay for unemployment, and they went so far to always have a lawyer when they went to court to fight the claim. I think it's unfair as well.

The employer doesn't get to decide, the state does. But the state people will talk to the employer to verify what you told them. If the two stories don't match, they'll question each party further, then make a decision.

Your employer "doesn't want to pay"? They HAVE been paying, for years, into the unemployment comp fund on your behalf. If you get unemployment it comes from that fund, not from the employer.

You don't give info on WHY you left, and that's what the unemployment comp people look at. If you quit, you almost surely aren't eligible. If you were laid off, you almost surely are eligible. If you were fired, being eligible depends on why you were fired.

the only way you can get unemployment without their ( former employer) approval is if you got laid off or quit because the company was moving to another area. there may be other examples where you can, but i'm not aware of them.you have the right to appeal. if it doesn't work then sign up for public assistance, the case worker will review your unemployment claim and may help you get it.

The employer does not decide. The state government decides. An appeal does not mean that you will not be paid. Many appeals are ultimately decided in favor of the claimant.

In many states, unemployment is partially paid for by the former employer. You wrote that you left the employer, which gives them the right to deny your claim. Unemployment in most states is left for those that are laid off or fired for reasons beyond the employee's control.

You need to speak to an attorney that handles matters in unemployment.

Call your local (usually county) bar association. Ask for their "Lawyer Referral Service". Ask for the names of attorneys that handle unemployment matters for EMPLOYEES.

When you call the law office(s), ask to speak to the ATTORNEY. Be insistent - don't let the receptionist corral you. Just tell the receptionist the main ideas of your matter to get to speak to the attorney. Save your details for the attorney. By the way, secretaries are NOT allowed to quote fees - it's the Unauthorized Practice of Law. When you get the attorney on the phone, #1 first thing ask about his/her fee - ask if they take payments, etc.
