It is illegal in some states, unlawful is a better way to describe it in terms. Depending on what state you live in, it may go against your states labor laws. However, due to the fact that your company is holding your check until monday they probably know they are within their legal guidelines. I say this assuming you work for a coorperation or a considerably large business. If thats not the case, and you are working for a privately owned company or a family business that operates however they want to, then you may be getting duped. The sad part is... if you mention to them that they are going against labor laws, they could be vindictive and just fire you. This is true because, also, most states are "at will" states... which means any company can terminate your employment for any reason (except discrimination). They (the company) can discrimninate, but then give a bogus legal reason as to why they are terminating your employment. Thats going off track of the original question, but i hope it answers you question. I know alot about labor laws (having several lawyers in my family). You may want to look into direct deposit, and see if your employer offers it. If they do, then you would not have to wait for your check... it would be automaticaly deposited into your account at midnight, the morning of your payday. Furthermore, companies in some states are required to carry "backup checks". These checks are hand written by an authorized person or manager. For instance- payroll checks are initially mailed to the owner of the business from a payroll processing company. Something goes wrong and they do not get mailed on the day they are supposed to. This means your boss/manager has to manually write you a check for the amount owed. This situaltion has actually happened to me before. HAPPY NEW YEAR!!! |

I guess it depends on why. I got paid late at my last job once because our computer system was down and things simply couldn't get processed with our bank on time. It wasn't a deliberate action of the company. |

Depends on your state laws. Many states require that paychecks be distributed not later than payday, which would mean the checks would go out today if the company is closed Thursday and Friday. |
