by law she is allowed 12 weeks of unpaid leave and her job must be there for her when she comes back...In texas, it is a hire/fire at will state, so she may get the time off but when she gets back she may be let go... |

She is in ENGLAND NOT USA.
Dont quote federal laws at her - thats totally not relevant.
If someone from England can list the relevant Labour dept website - I cant seem to find anything. |

Employers make the rules. They decide if they need a person full or part time and have the right to change based on their needs. She can claim discrimination but I don't think she can get away with it since the appraisal showed the need in advance of a full-time position and she was informed that's what was actually required for the job. |

I'm just guessing, but I don't think any employer can mandate you to go from part time to full time.
I do know there was law a law passed a few years ago for women that have babies can take a leave of absence without losing there job. This is a federal law, you might want to research it and see if there is anything in that law that would pertain to your wife's position. |

I would check out the family medical leave act... http://www.opm.gov/oca/leave/HTML/fmlafac2.asp If the employer is doing something illegal she could sue. |

yes, your employer is right. federal law only gives mothers up to 12 weeks of unpaid maternity leave. it's you employers choice to change her hours or not or to let her go. and it's not dicrimination. |

When returning to work after maternity leave you have the right to employment under the same terms and conditions as before your absence. Therefore, if your wife's current contract is a part time contract then she should go back to work on the same basis. |
