Life insurance is a contract in which the life insurer assesses the risk associated with an individual on the basis of the information provided by the person in the proposal form.
A recent survey also found that 20% of the customers prefered to withhold information of overweight or about their smoking and drinking habits. But that is only detrimental to their interests. “The principle of any insurance contract lies on 'utmost good faith' wherein both parties need to be factually transparent. It will be to the customer's benefit to give in correct details about himself and his health as in the long run, it is going to be the customer that will benefit or suffer due to the right/ misleading information provided by him.â€
If your wife had with held the information at the time of taking the policy, the insurance company can repudiate the claim !

There is no law (that I am aware of) that requires a company to give anyone health insurance. The company has apparently done a risk analysis on your wife and found that she will cost more than they are willing to pay. Overweight people have higher risks of: diabetes, high blood pressure, heart disease, bad joints, etc. etc. etc.

There was a story in the news just a few weeks ago that told of Australia refusing a woman's request to immigrate because she was too fat and would be a drain on their socialized health system.

I would think since they probably have a whole panel of legal people who's job it is to know the legalities they are fully aware that is it legal. Not that I have any room to talk, but being overweight does pose heath risks and is a precursor to different ailments and illnesses, so yes they have the right to deny.

If she's considered morbidly obese, they can turn her down because it's a pre-existing yet controllable condition. My second ex went thru the same thing. Now she's insulin dependent diabetic.

BC is a private company and can deny or approve those it wants to do business with.

Until 'gov' gets in 'insurance' she needs to keep looking.

Any insurance company can increase premiums if they feel there is an extra health risk. If they didn't it would be like a car insurance company charging the same premium for good drivers and those with many accident claims.

They can also refuse to provide cover if they feel she is too high a risk.

There is a message here. If in their experience they have found people of her weight/height tend to die younger, shouldn't she be worried and lose weight?

Your question is not specific. What do you mean by overweight. How much is her weight. The Insurance Company can deny if it finds that the Insured whom they think to cover is having more risk to health then a normal person. It is advisable to become normal rather than be abnormal which makes you away from obtaining various benefits of Insurance.

If they deny insurance to everyone who is above their limit, it is. Should we be mad about this? You bet. It is high time for universal health care if not socialized medicine. Hillary Clinton offers the best hope of insurance reform.

They can probably make the rate higher, like they do for smokers, but I don't think they can straight up deny you.
