I have been married for 2 yrs, my husband and i are not doin so great and are talkin about divorce.....

Well my husband purchased a home 4 years before we got married.his mom put a downpayment of 10k. He lived with his family and they all equally divided the bills.(he was the only one w credit)

when we got married..i moved in with them and lived together for a couple of months..i started paying bills also...
HIS family decided to buy a new house..we wanted to keep our house so we made a deal w his mom..to give her 13k for the downpayment.
I took out a loan under my dads name to get this money..and my husband and i planned to pay equally.

So we have been sharing the house bills for 1yr n 6 mos...and we are renting a room to a friend..

Now that we want to divorce..THE house is only under his name..and i want to kno what i can do ???..i dont believe its fair for him to just make me leave the house when the divorce is settle when i have been helpin him pay the house and the loan..
Is there anything i can do??

Do not be so worried. When you meet with your divorce attorney this should be part of your decree. Although your name is not on the deed I would imagine you have proof it was your father who took out the loan making you a silent partner of sorts in the purchase of this home. You must see an attorney. You cannot do this on your own. If you attempt to do this without the assistance of an attorney who can represent you I can assure you, you will get screwed.

You need to speak with a good divorce attorney to help with the personal property settlement. It will be worth every dime you spend.

You need to contact a lawyer. Don't leave these cases to a public forum. That's like going to MCdonalds for advice on cooking a Steak.

I think that you are going to have to fend for yourself . You cannot get a house if he owned it prior to marrying you.

I am sorry to hear about your matrimonial difficulties. Every couple goes through difficult times. It takes a lot of effort to make a marriage work. I hope you can work things out. If not you really should consult with a lawyer who specializes in divorce law. You certainly have equity in the house. If the house was in your husband's name prior to you being married then that could be reason enough to get the house. It will be up to a judge to decide what will happen to the house. He could force the property be sold and the money be divided or give it to one of you or both. Laws vary from state to state. If Texas is a community property state then you both may share in the ownership or profits from the sale.
