National minimum wage?

hi there i work for a small firm and one of the apprentices who has been employed for 18 months is only getting paid 3.85 per hour. he turned 18 3 months ago but is still only getting paid 3.85 per hour. i thought the minimum wage for his age is 4.60 per hour how does he stand from a legal point of view. thank you.

Please have a look at the link below, page 17, which explains how the minimum wage is applied to apprentices.

Basically, apprentices who are under 19 are not entitled to the minimum wage.

If he is on a recognised apprenticeship and working towards a qualification then he is not entitled to national minimum wage until his 19th birthday. Once he turn 19 he should go onto the development rate of £4.60 per hour until his 21st birthday when he will transfer onto the full rate of £5.52.

Apprentices as far as the minimum wage is concerned
are either:
● workers who have contracts of apprenticeship; or
● workers who are taking part in the specific training

These are the rates of National Minimum wage.
Hourly rate of NMW: From 1.10.07
Standard rate of NMW for workers aged 22 and over
£5.52
Workers aged between 18 - 21 (up to 22) - reduced rate NMW
£4.60
Workers aged 16-17 (Up to 18)
£3.40
apprentices aged 19 and over do not qualify for the national minimum wage for the first year of their apprenticeship. Once they have worked as an apprentice for a year, provided they have reached the age of 19 and are still working for the same employer, they become entitled to the normal minimum wage for their age.
Workers aged 18 (up to 19) or under, are not covered by NMW.

£5.52 per hour for workers aged 22 years and older
A development rate of £4.60 per hour for workers aged 18-21 inclusive

thats not right and it should be dealt with.
and i have to say that the minimum wage is the worst thing that could happen to anyone. this is what the labour government has done to us. how is it right that anyone , teenager or whatever can be allowed to work for this sort of money? its disgusting.

He should be paid and the company are in breaach of employment law. He should contact a Trade Union even if he is not already a member. They will help him to win his case failry and properly without any problems.

I thought it was £5.45 or there abouts (it was £5.45 when I was last working part time in a minimum wage job just this time last year) for when your over 18.

Your friend needs to remind the boss his age is now that which requires a higher payment and they will comtact payroll on his behalf. If they dont, then he needs to contact the companys payroll asap, they should also back pay him what he is due.

If they refuse to bring his pay up to date, then he should contact the CAB- he can either do this by phone, email but best is to go see them and speak to them, they will help him get it sorted.
