Need advice from civil lawyer please?

A family member was attacked raped and then choked with a cord untill she passed out. Perpetrator is 19 and probably does not have a dime to his name. he is being charged with felony csc and attempted murder, would a civil suit be worth or should we just leave it at the criminal level??? Please any advice would be much appreciated!

Wait until the criminal trial is over. You may be able to sue and get a judgment fairly easily is the guy is convicted since the criminal standard of proof is higher than the civil. While the judgment may not be collectible, it will be valid for a long time (in NY, 10 years and renewable for another 10) and accrues interest. You never know what's going to happen in the future. A judgment may be a handy thing to have in your back pocket.

You need a lawyer to review the total case to see if there is a deep pocket that can be partly blame. Negligence attorneys often don't charge for an intital review. Check this out.
