Need some legal advise; someone please help ?

If you have a misdeamenor on your record for a check that was written years ago, it was paid off years ago as well. Will this always be on your background checks or can you get this dismissed or aspunged since it has been paid off. This happened over 5 years ago.

..I just want to add I am self employed, I am not seeking work. Is there some steps I need to take in order to have this removed from the background report. I was previously told this could not be removed from the report, I was hopint that someone out there could give me a different answer and some suggestions to help me get this matter taken care of like an Attorney or a Law Student.

this may not even show up but it can for 7 years.
even expunged records can (not always will but can) show up.

a background check can not be used to make a negative employment decision prior to you being given a copy and having the opportunity to address or have corrected any issues found. if you have been honest and explained this ahead of time there won't be an issue or a surprise to the employer.

there is no way to have this erased completely, even expunged records can be seen by law enforcement and once a record is public (which court records are) there is no way to be sure that it will never be found again. you need to just deal with this (if the matter arises) in a professional, adult, honest manner.

you made a mistake now move on this will only effect you if you allow it to.

Without specific Information regarding the actual charges, it will be virtually impossible for anyone to give you a solid answer.

You can do a couple of things:

1. Run a background check on yourself and see what comes up. If it's on there, and you believe that it shouldn't, contact an attorney that specializes in this type of law to help you.

2. Go to www.usa.gov and search out "background check law" and the state you are in. You may have to sift through a lot of Information to find the information, but it's a very powerful resource for this type of question.
