Need to know? Is this legal?

Is it legal to work someone 7 days a week. He works 7am-5pm (10hrs) and on sunday 7am-11am. Is this legal, aren't you legally in titled to at least one day off. Sundays are out church/family days and he already informed his employer that he cannot work sundays. They told him that if he missed more than 3 sundays that he will get fired. Before he goes taking off and getting fired we want to know if they are allowed to work him that much. He only make $ 8.50, and he works threw a temp agency (don't know if that matters).

If you know the answer to this can you try to give some credible information to back it up. So he doesn't go in telling his boss things that we have no idea about.

He did not tell them before he started working there. But they did not tell him what days he would be working untill after he was already hired and they never asked him if he had anydays that he was not available.

in the US federal law does not mandate any time off for those 18 or older for most jobs (exceptions include mining, transportation) but some states do require one day off in seven......
without knowing where you are this question can not be answered accurately.

edit the question or call your state's (if, in the US) department of labor.

There's nothing illegal about it. It's nasty, and it's insensitive, and for that wage it's darn near slavery--but there isn't anything illegal about asking an employee to work 7 days. Days off are not an entitlement.
I think he needs to try to find another job. Even fast food restaurants will not work you all seven days.

Whether something is legal or not depends on the country (and state/province) you are in.

Here in Canada, it is legal to work someone 7 days/week -- but you have to give them time-and-a-half for one of those days, to compensate for not having a day off.

If when he was hired he told his employer that he was not available on Sundays, then he cannot be fired for not working on Sundays -- they knew this information, so they can't fire him for it. If, however, he told them *after* he was hired, then he can be fired -- because they hired him thinking he was available all the time.

The Fair Labor Standards Act does not limit either the number of hours in a day or the number of days in a week that an employer may require an employee to work, as long as the employee is at least 16 years old.

During the initial interview your friend should have asked every question he needed to know about the job before he excepted it. I understand how people can get nervous during an interview. It's always a wise thing to write down any question a person might have before going to the interview. It's hard to remember everything you need to ask. You can always refer back to notes written down before going for an interview.

Guess it all comes down to, don't rely on the boss to give you full low down on job description. Rely on yourself. Lesson learned.

By law, if he isn't management he has to get time and a half for every hour above 40 he works.
