My partner and I raise puppies. My partner consigned some puppies out to our groomer to sell, and when she sold them, she were to give us a certain price for them. She also took a mother dog (until the pups she took were weaned) pet carriers and cages. She took a total of 13 litters of puppies in a short amount of time,(all the dogs had pups about the same time). Paid all but $40 for the first litter, and when the puppies all sold, now she's claiming that she doesn't owe any more money, is holding our dog, says she won't return her because of a vet bill, when we found out she never had to take her to the vet, and has sold the cages on the internet. We have proof of all this.
The thing is, she lives in Macon county Tn, and we live in Ky. She took the puppies from KY and sold them in Tn. We have talked to lawyers, police, a detective and numerous people from both states, but none can agree where we should file suit. None are sure and can't help us. We take good care of our pets, and found out that the groomer had them in horrible conditions at her place. We are worried about the safety of our dog Tia, and are out of over $7000. Can anyone help us? (this is my elderly partner's only income, and I foster unwanted dogs and sell a few puppies to be able to take care of the rest, so please no posts about how horrible we are for raising dogs, we take good care of them)
Also, we found out that she had sold sick puppies to people (where she had them in horrible conditions), didn't take them to the vet like she should have, and like she claimed in her ads. And slandered us on most local sites just for trying to get her to pay us. Should any or part of this be civil or criminal.

I am not a lawyer and cross state line issues can complicate an already complicated case. But I recommend you go after her both civilly and criminal. You would sue her in your home state. But you would pursue her criminally in her both your state and her state. You will need evidence to file charges for all the crimes she has committed against you that you would file in your home state. For charges of cruelty to animals in her state you would only need to report those crimes according to Tn law. You should retain a lawyer to file your suit and criminal charges in Ky. |

Not a lawyer...but I guess is that you would sue her in Ky since that's where the original contract originated (either written or verbal). Maybe you can talk to other breeders in your area or the pet shelter in your area to gather some referrals. |

You need to sue her in TN for your judgment to be realistically worth anything. Yes, your contract originated in KY but if you get a judgment against her in KY, good luck collecting anything since she and her assets are in TN. Its complicated, at best, to collect a judgment from a resident of another state and you'd have to go thru a local court in TN to uphold any judgment from KY anyway. If you get a judgment against her in TN, you can attach her assets with the force of the TN court. I'd also press criminal charges thru the local TN police force. Again, if you do it in KY, they'd have to extradite her to KY and they probably won't do that for the crimes we're talking about. Too costly to the state and too complicated. Get yoruself a local atty in TN and start the proceedings civilly there; contact the local police there and file charges against her, assuming you have enough evidence. You won't get monetary damages from criminal charges but you'll get the satisfaction of knowing she won't deal with defenseless animals again. Good luck. |
