Okay about 3 years, my aunt and I set up a checking account with X bank because I received a check from a company. Well the check turned out to be fraud. The bank couldn't do anything to me because I was under 18 and didn't know anything about the check being fraud although I spent 500 dollars out of it. The account was cancelled and closed. The bank vowed they cannot do anything to me since I wasn''t of age, so I was apparently forgiven, no letters, no phone calls, nothing. Well two months ago, I set up a checking account with the same bank to receive my student loans to get books and pay some bills. Well the old account has nothing to do with me now 3 years and an adult status later. Well when I went to use the much needed money, the bank had taken all of the money out of my NEW account saying it was for the old account. They didn't warn me, send me a letter, or anything. They just took it out! This caused much hardship seeing that I cannot pay my bills, eat when needed, or buy the books I need for college which is causing me to suffer in class. I contacted the bank and they would not give me my money back and allow me to pay it in increments. My question is can I sue the bank for causing such hardship when the old account was used while I was a minor which is a law of some type. I'm still in hardship which is the underlying cause for the lawsuit.

If you can PROVE that the bank forgave you for the other account, then yes you have a basis for a law suit. Good Luck. |

No. Here's what they meant...
Banks are notorious for doing then when someone owes them or a third party money.
They couldn't take your money WHEN you were under the age of 18. However, you no longer are. You will owed them money, and unless you signed paperwork stating that the bank is "forgiving you for spending their $500" then they weren't. I understand why you would think it's illegal, but unfortunately it is, and would hold up in court. So I definitely wouldn't even waste the time. Count is as a loss, cancel the account, and go somewhere else.... OR, pay the money.
You may however experience if you put too much money in ANOTHER bank, they will in turn take your money as well. |
