I work at Beach Bums in Queens, New York. I worked one day for 12.5 hours (1:15 AM-1:45 PM) and then actually just yesterday I worked a 16.25 hour shift (4:00 PM-8:15 AM). Aren't you supposed to get overtime for anything more than 8 hours in one day/night? I didn't receive overtime pay for my 12.5 hour shift, and when I asked my boss about it this morning she said we don't get overtime, and that I wouldn't be getting it for the 16 hour shift I was just clocking out for. Is this right?
Additional Details
Also, I don't know if it makes a difference, but I'm alone from 12:00 AM-8:00 AM. So I have no coworkers to help me on my shifts.

in new york overtime is based on over 40 hours in a work-week not how many hours you work a day.
there are also some employers and numerous jobs that are not covered by overtime laws and/or minimum wage. most employers are covered but not all but either way the overtime will still be based on the employers work-week and not daily/shift hours. |

Overtime by federal law applies to hours over 40 worked in a week, not any limit to the length of a shift. Some states do mandate overtime pay based on the hours worked in a day, but NY doesn't. California does - I don't know if there are others that do.
Working by yourself or not doesn't make any difference. |
