No scheduled day off, is this legal in the state of Indiana?

Help, we are tired and our bodies ache. The non-union company I work for schedules us for mandatory 7 days/wk. for several months at a time. In order to get time off we have to call in and take a point, have valid FMLA , use vacation days to schedule a weekend off or pray we have enough senority to volunteer off providing they take volunteers.

Many of us are now facing health problems and work comp injuries form repetitive work. Of course they deny this saying we have arthritis or strained muscles only to find out it's really carpal tunnel or a torn rotared cuff.

Thought about leaving, I'm 60. Excellent insurance & retirement plan. Just want "free" time off with my family.

I could not find anything that says that the company is required to provide you any days off. Plus, you can be fired while under workers' compensation.

They don't have to give you days off, although legally they DO have to pay you overtime for hours worked over 40 in a week.

Your option is to look for a different job.

Even if it is not legal, at sixty, surely you realize this tactic may result in much more time off than you had expected. My brother always said: "It's better to have money and no time rather than time and no money."

A Quixotic battle is not likely to make you a hero to your co-workers. Good Luck.

You need to check the employment laws in your state. I know that here in New York and employer cannot make you work more than 12 days straight. Then them must give you a day off.
