Well I have a complicated situation. I'm 16 years old and started working at a seasonal Halloween store and never got a work permit to work there. I walked in one day and asked for an application, the manager told me one day that I needed to get a permit but never followed up and I kept working through the season with all the proper paperwork (W-5, payed taxes, etc..). Well, this is where the story gets interesting. They started issuing us ADP Total Pay Cards for our paycheck. Me not knowing just activated it, signed the back and continued using it for purchases monthly. Well the job is over and apparently not knowingly I over drafted it by $2 at taco bell. Well I got declined at McDonalds so I called them and the Rep explained to me I would have to pay $25 and said it would come automatically come out of my next paycheck. Well I'm not getting another paycheck and forgot to mention this and forgot about it. It's been about 2-3weeks now and apparently my father told me someone called for me while I was at school saying I owed like $300 and they would call a Collection Agency. Well what do I do now? Can I claim that since I didn't get a work permit they had no right to send the paycheck to the paycard or pay me in general? Will this go on my credit history? ANY help would be helpful.

Working without a permit has nothing to do with getting paid. They are most likely two separate issues.
Your employer is typically responsible for ensuring that they are compliant with labor law, so allowing you to work without proper documentation is their cross to bear. And it's one that will probably cost them a sizable penalty
On the other hand, the paycard is your responsibility. If you overdrew it, it's no different than overdrawing your bank account - because that is exactly what a paycard is - a bank account. And those come with overdraft fees.
If this has gone to a collection agency, then it is highly likely that it will negatively impact your future credit no matter what you do at this point. The fact that you were able to open an account as a minor means that you probably had to have a cosigner, who will also be affected negatively.
Bottom line, talk to an attorney who specializes in finance/credit law and see if they can dig you out of this hole. |

The point is you did work & they did have to pay you or they could get in trouble. Talk with this person who called & only agree to pay the $25. IMO this is how I would handle it. You could call an attorney to see what to do & get help. The fee maybe a small price to pay in the end. |
