Is it illegal for your employer not to let you leave the store on your designated break time. I work retail part time and my employer recently stopped letting us leave the store on our breaks.

most states do not even require breaks be given but.................
if a break is given and it is less then 20 minutes it must be PAID and the employer can make you stay on site.
if a bona-fide meal break is given then it must be at least 30 minutes, uninterrupted, no work may be done during that time and it may be paid or unpaid.
in a couple of states such as California if a break is UNPAID then the employer can not restrict the employee in any way.

If it's a paid break, then yes they can require that you not leave. Technically if you get hurt while 'on the clock' even if your off the property then they're responsible. Like if you get in a car accident, it would be handled as worker's compensation. If it is an unpaid break, something you have to clock out for, then contact your states labor board and ask them. .I had an employer tell me I wasn't allowed to leave on an unpaid lunch and I called the labor board on them because it was illegal to do that in my state. |

As a general rule, if it's a paid break they could set rules about whether you can leave the store, but if it's unpaid they can't. If you are talking about a lunch break, it might be illegal - depends on your state laws - but if it's a 10-15 minute break, then they can set the rules. |

If your in a union,and you should be,contact your rep.
Some firms count the breaks as part of your total working hours and may even pay you during the time. if that's so,then they can ask you to be prepared to get back in case your needed.
If that requirement is laid down in your tems of contract,then they are perfectly within their rights, Ask to see your terms of contract.

we have to punch out when we leave the building cause it is said our job is responsible for us if there is an accident or something.if you punch out you should be on your own time.there should be a 800 number posted in your break room you can call and ask about it. |
