Notice period to apply pay cut?
Find answers to your legal question.

Notice period to apply pay cut?

how does the application of a pay cut work? does the employer have to apply the pay cut only after completion of notice period in the employee's contract? or can employer enforce it immediately?

for example if an employee has 2 months notice, then can the pay cut be applied by employer after 2 months, after serving proper notice etc, or can it be applied like tomorrow?

where are you?
if you have a contract this should be covered if it is not then the local labor law would apply.
in the US your rate of pay may be cut but in some states as much as a full pay-periods notice must be given (most states only require that notice be given before any work is done at the new rate).

If you are in the UK then any pay cut would be a breach of your contract of employment. If you are willing to agree to a pay cut then they would have to give you the same amount of notice as if they were terminating your contract of employment. In your example this would a statutory amount of 1 weeks notice i.e. 1 weeks notice for each complete year of service to a maximum of 12 weeks - you may be entitled to more under your contract of employment - whichever is the greatest will apply.

If you are not willing to agree to a pay cut and your employer forces this on you then you can take a claim against them for breach of contract. It is a defence for your employer to show that there are genuine business or economic reasons why they change has to be forced upon you.
