Ok. This is what happend to my wife this morning.
Shes is an RN, was working in florida, i am working in texas, she wanted to move to dallas texas, conatcted her travel recruting office and they promised her a job in dallas.She resigned her jon in florida, moved to dallas, found an apartment next to the hospital, paid 4 month rent in advance and went to orientation this morning and the hospital told her she dont have a job. The recruiting agency says they will give her another job now whcih was not what they promised her before, she works in icu and they dont have that opening now.
what shuld we do? sue them or conatct consumer protection?

she was stupid, didnt take any written contracts, just went with the recruiters word, all she has now is verbal contracts and some email conversations. What the best thing to do? Shew dont want to do the other job cuz thats not her speciality?

Doesn't sound like she doesn't have a job, just not exactly the one she wants. Best advice would be to take the job they DO have, and wait for an opening in ICU and apply for that.
You have no legal case. So forget about suing them. Sounds like they had an opening in ICU but for whatever reason they don't now. That could have happened a month from now - and then they'd transfer her to another area if they didn't want to just lay her off. |

What does your wife have in writing regarding the job she was promised in Texas? I'm assuming she has something, since she relied upon this offer of employment when she resigned, relocated, secured an apartment next to the promised employer (hospital) and paid four month's rent in advance.
A few things here. First, she'll need something in writing to go after the agency. While she can try to sue for specific performance based upon what the written promise of employment states, if the hospital doesn't have an opening in ICU, suing won't make one happen. Forget consumer protection. They won't do anything.
Did your wife speak to anyone at the hospital in Texas prior to moving, to confirm orientation, start date, etc., or did she just show up for orientation? I suspect a case of bait and switch, which is common with placement agencies.
My suggestion to you would be to have your wife take whatever job she can get until there is an opening for the one she wants. Provided that she has something in writing from the agency, she should require them to make up the difference in salary or risk legal action and bad publicity by way of one of those "Shame on you" local news segments.
If all she relied on was somebody's word at the agency, you're SOL. This is why it is critical to ALWAYS GET IT IN WRITING. |
