i was sacked from my job in january (i was working in a pub) and i found out i was sacked as i recieved a letter through my door (delievered by hand), the letter didnt explain much and it also said that i was barred from the pub.
I tried phoning the pub to ask about it but my manager was really rude to me and told me that she didnt have the time to talk to me, so that got me nowhere, so i instantly took the case to an employment tribunal. I knew i ***** get them on unfair dismissal as i had only been wrking there 3 months, but could get them on breach of contract etc. I filled out the form and then got a response within a few days saying that the case had been accepted. Few weeks later i recieved the response from the pub outlining why i had been sacked, which was for apparently posting nude pictures of myself on the internet and then telling staff and customers to look them up, which is a load of bunkum, both of those statements are untrue.
Ive now got the court date but i have been told that i need to prove my old employers wrong to win the case, but i have no idea how i can do this Additional Details i havnt got a solicitor atm, but i have got an interview with the CAB in a few weeks time to try and get some advice

First of all, it is up to them to prove that you *did* post the pictures and tell staff and customers to look at them. Then, only if they come up with good evidence that you did, do you have to prove then wrong. So really, if they don't have any evidence, there is no way that you're going to need to prove them wrong.
However, something that you could think about is trying to get character references who would verify that you didn't do it. It's unlikely that current staff would support you as they'd be too scared of losing their own jobs, but if there are any former employees or any customers that might support you, then it doesn't hurt to ask them.
I'd also think about why the pub might have said this - was there a particular person who didn't like you, or did you do something that might have made them want to get rid of you? That way you can argue that you think the real reason for your dismissal was something else. It could even be a reason that isn't directly related to you, such as wanting to give a job to a friend or family member. |

There are two things that you need to be clear on before you take things any further.
You submitted an application to the tribunal for a breach of contract and the tribunal have accepted the case based on the information you provided to them, this is now what you have to prove how in your opinion did the employer breech the employment contract.
The fact that your employer then came round after you had an acceptance for the hearing, and posted a letter through your door if this wasn't mentioned as part of the tribunal application then it won't be discussed. Don't get mixed up with before and after events.
But i would get some advice and help if you can |

Seems to me they are going to have to have the staff/customers come to court and testify.
Was your manager always rude to you?
Sounds like they may have wanted to get rid of you using any reason.
