He stated
"there are deposits that were not entered, income from fees put into expense accounts, credit card payments not distributed to the appropriate expense accounts"
which is not all true. I did miscategorize some of the deposits, and that was it.
He also stated that he would be hiring someone else to "attemp to dicipher what I did" and said
"If it cannot be salvaged easily, then I will pay this accountant to get Quickbooks into the shape that I paid you to have it in. I will then look to you for payment of this cost. If you do not pay, then, of course, I will sue you for the money and all of the money that you cost me to re-instate my insurances and other services that you caused to be canceled, etc."
However like in my last question, my hands were tied as to what I could pay.
What do you think? Additional Details BTW, I am in California
So like I said, my hands were tied as to what I could pay because he would only respond to one or two of the bills I sent him, and I would send a list of about 20-30 at a time. I assumed that he did not want them paid, so when the lapsed because of non-payment, he got mad. Now he is threatening to sue me for reinstatement fees as well.
He also said I took payment for a month I did not work, and that I should return it to his office immediately.
I never took money for a month I did not work, and told him if he had read quickbooks correctly he would have seen that.
Sigh, hope anyone else out there can help me?
So my question is, can he sue me? anf if so, for what?
Losing his company money for negligence? I mean I only paid the bills he told me to pay.

you CANNOT be sued by your employer except under certain conditions, that would mostly pertain to embezzlement or stealing even then it would considered a criminal matter and the state would pick it up. He sounds a little irate but not to worry. If everything is as you said then he will find what you miscategorized. Glad you liked my answer to your other question, thanks |

As an employer he can only make you fix your own mistakes not make you pay for them, and of course fire you. The only way you would be liable would be if it was malicious, and that is a different story. Being an incompetent employee will only get you fired and he is responsible for your mistakes, and lack of foresight when he hired you

He can file the paper work to take you to court, but that will cost him money. Can he do anyting to you, no. |

Were you an employee or contractor?
In the UK the difference is likely to be important, although your link suggests you are in the US?
Look at your contract, and decide from it whether you have breached it materially. If there is no contract what is the basis of any lawsuit.
Likely to be trying to scare you off any complaint against his firm, but take advice from a solicitor if it seems a serious threat. |
