PLS ANSWER! Employment verification?

I am currently on a leave of absence due to having a baby. I was supposed to be back to work 2 weeks ago but couldnt find a babysitter. I was told by my employer that I could work PT after baby and then they changed their mind so I didn't have enough time to find full time babysitter.

When I asked for 2 weeks to find a babysitter, they said they would get a temp and can't really guarantee my job back. However I do still show as on 'leave of absence' and they didn't hire the temp.

We are in a process of almost closing on our house. If our lender calls one last time before we close, what do you think will happen? Can they legally discuss anything else other than saying that I am on leave of absence?

BTW, we do have enough and can make our payments easily even with one income!

They can only disclose the dates of employment and position.

Since you are on FML, they will not say that you are on LOA they will just state your start date and say yes you are still an employee.

Your employer should not be giving out any information about you other than your basic status prior to your absence. (FT, PT, salary, etc.)

Is your employer subject to FMLA regulations? If so, you are entitled to up to 12 weeks of unpaid leave time following the birth of your child and they have to hold your position or a comparable one for you.

I would contact them and get a definite answer about your current employment status as that will be the information they will give your lender.

no, that's all they can say is that you're on a leave of absence.
and if you don't need the job to make these payments, i would strongly suggest you stay home with your child for the first two-four years of their lives, they'll turn out better!

ANSWER: The call will most likely go to the HR department. The HR department will answer as to your current status which, at the moment, would be "leave of absence." They're not likely to (and they certainly shouldn't) say, "Well, we might hire someone to replace her." They should (and most likely will) stick to the bare facts. Now, if the lender really persists, it might ask questions like, "Is there a full-time position for her upon the end of her leave of absence?" Or they can ask: "Is there a set time period for her leave of absence?" In other words, they can stick to the facts when asking. And your employer may, if it chooses, answer such factual questions.

That's the way it should (and probably will) work.

And if you're correct--that you have enough and can make your payments easily even with one income--then (if the loan underwriter agrees that the other income is sufficient) your income contribution really shouldn't matter.

But right now, the right answer (and the one your lender is likely to hear) is "leave of absence."

They can legally report the truth. If they decide to terminate you while you are out, then they can report that to the lender. The lender may request to know the date you are expected to return to work ... you've already signed paperwork allowing the lender to request information, so you might be out of luck.

But if your income isn't needed for the loan, then don't sweat it.
