Past employer still threatening me?
Find answers to your legal question.

Past employer still threatening me?

After quitting my job almost three weeks ago after working in a environment of harsh speaking staff and negativity-

I have gotten 3 letters from them about company property(which I already have returned via certified mail) and an exit summary they wanted me to sign which I did not sign .
The summary stated I abandoned my job and had incorrect dates ,etc.
Now thier latest letter states they will tell the Insurance commissioner that I abandoned my job- so I cannot get licensed to sell insurance.

????

I have read the requirements to get licensed in my state- pass the necessary exams, have no criminal history (which I don't ) and to pay required fees- quitting a job is not a crime.

Are they harassing me because they feel I may file for unemployment or is this just plain revenge?

My attorney is not able to get back to me until Monday.

Any feedback is appreciated

Questions that come to mind:

1. Did you give notice?
2. Why did it take three letters from the company for you to return their property?
3. Why did you not want to do an exit summary with them?

If you did not give them notice but just stopped working for them then it would be job abandonment.

I would suggest you give someone at the company a call to find out why they have classified you as job abandonment.

quitting " for cause" is one thing you can go through the hearing process to get unemployment and get your records straight. your company cannot force you to sign any document or evaluation, or threaten you, imply or threaten your future work eligibility. this is the law.. reprisal and "black balling" a former employee is illegal under state and federal labor laws. be certain to file complaints with your state and federal labor departments.. don't give your former employer or anyone except your lawyer any information.. if they try to get anything from you, tell them to talk to your lawyer, and hang up. continued phone calls could be a cause for harrassment. keep a record with details of your contacts for your lawyer. digg.!!!the most they can do is tell the insurance commssioner you are no longer employed by them as an agent, and no longer represent them. the state will automatically deactivate your license until you are employed by another insurer, and approved to represent them. the license will then become activated for you and your employer as their agent. you can become licensed as a broker if you qualify under your states insurance codes.

It depends... did you provide notice to your employer, or did you not?

very tricky situation you are in...
my best bet would be to wait after your lawyer, but here i think about it.
the compagny might be pisted of if they were the first compagny that you worked for in the field of your certification. They are maybe afraid that you will go see and rival compagny to give them secret informations; who knows what's on their mind.

Just be extra careful of what you do until you hear from your lawyer, you do not want to get in anymore problems that you already are with the compagny, and you do not want to ruin your chances to get another, better job somewhere else in the same field.

Hope all goes well for you, and that you win your case

Quitting a job isn't a crime, but did you sign a covenant not to compete? Usually they're specified within a certain mile(s) radius of the previous place of employment.

The main reason [if you didn't sign a covenant not to compete] would be to have ammo to deny unemployment.

JULES, UK.
If you already know that quitting your job is not a crime( that would be a bit daft, how would you ever leave?) I would keep a record of any contact, via phone, mail, e-mail., I would then not give them the satisfaction of a reaction, what harm are they doing except being very childish, bitter and irritating.
Are they worried about their client list, the letter you not signed may have a clause stating that you cannot coax or take any clients to your next job... Yhey have to protect themselves aswell
Now if they can affect your future prospects, disregard the above and seek advice as you are doing..

You can not get unemployment, you quit. Who knows why they are doing? Technically you quit, so I guess they can say that is abandonmet. Kind of a stretch, but I could see it.

They are not harassing you. Perhaps they did not get the stuff back that you sent in the mail yet, and about the letter, call the company, tell them what was on the letter and ask them about it...
