Pay discrimination with a job?

I am working in a little store and have been for 3 years. I am a good worker who is self-motivated and rarely call off. Originally I worked 4-5 days a week part time for approx. a year. I moved quite a distance and now only work 1 day a week for the past 2 years. I am payed min. wage. I recently found that another employee performing the same job is payed .50 cents more than me an hour even though she is not as hard working as I am and has only been employed for 2-3 months at the store. She is not more experienced and this is likely her first job. I mentioned this to the boss and he stated my availability as the reason for my low pay. I see this as discrimination being that we are payed by the hour. In a sense this would be like saying that my availability is more important than the quality of my work, and that my time is less valuable while working than other employees even though we are payed an hourly rate to do the same job, just because I do not work as often as they do. The way I see it is a business either accepts your availability or they don't, but can't discriminate hourly pay rates based on this. Is this discrimination in a legal sense? I know the law states that businesses can't dismiss or treat employees as less simply because they work part time. Would this be within this guideline?

You might see it as discrimination, but the law doesn't. Legallly, discrimination is being treated differently due to things like your race or gender. The owner can pay you whatever the two of you agree to as long as it's at least minimum wage. What he pays anyone else has nothing to do with you, and is frankly none of your business.

Your legal rights here are to quit and find another job if you aren't willing to work for what he's willing to pay you.

Expecting equal pay to the other employee might be the way you see it, but you have no legal basis for seeing it that way. And it is NOT discrimination. And I'm not sure where you get what you "know" about the law and part time employees.

the law does not provide protection concerning pay rates unless it falls below minimum wage, employers are free to pay how much the y want to whomever they want. It is not a protected class
