Please help me about unemployment Please :)?

can I get unemployment if I resigned under the following: #1 they had been doing major layoffs, my workplace was broken into ( had stuff stolen personally which made it even more scary) and there was no security system in place what so ever #2 I gave a 2 week resignation and they let me go earlier than the date requested (1.5 days after I gave them notification, they let me go immediately/ on the spot) #3 I was treated very poor once I handed in the resignation, by superior #4 Superior pulled all work under my jurisdiction and I had no work to do period #5 I had taken FMLA a few months earlier and my superior was saying that they think I was lying and they were saying ill things about me personally due to this legal, required and documented time off

You are not entitiled to unemployment. You resigned. If you feel that some of their practices were illegal, you need to speak with an attorney.

IN many states you can receive unemployment for the notice period if your employer immediately accepts your resignation. You can possibly collect for the two weeks. File now.

To answer your q properly requires more spacethan I have, but I will try to help you. 1st off, if you resigned VOLUNTARILY in the 1stplace, you are the moving party in the sep of employ-this means that you would have burden in an unemploy case to PROVE good cause-some threat to your health, safety, or other compelling reason that forced u to resign. You then have to show you gave your employer a real opp. to correct the problem. This is called "constructive resignation" If you can take wriiten proof of your intent to work 2 more wks(very important) and your employ called in your resig before that, you have to a chance to turn the emplyer into the moving party in the sep of employment-that puts the burden on them to show willful misconduct or other intentional disregard of thier business interests. in order to get u denied unemployment. Depending what st your in, some intepret unemployment law more liberally than others. You unlilkley will be denied unemp. if you simply didnt perform your job tasks well, had personality problems w.co-workers, superiors, had other job related problems that were not INTENTIONAL or WILLFUL. Work on that angle-try to turn your case around so that it is a involuntary termination because you intended to work longer, make the employer prove you di something willful or intentional. If you resigned your job then you will not qualify for unemployment. They would say that you quit your job without having another one to go to.

You could try to file a claim and see if it will go through, no cost to try. If the employer shows them that you resigned it will most likely be denied.
