Pre-Employment Background Checks - Tell the Truth?

i asked this question last night but didnt get the answer i wanted so here goes again. I have two driving charges vc.23103 and vc.23140 one being a infraction and one a misdemeanor. i recently had these charges expunged but according to the clerk at the court these charges still remain on the record but will say "dismissed". now what i'd like to know is am i suppose to mention this to employers or just answer "no" when it asks if i've ever been convicted of a crime.
the word thats usually used is "convicted" which means that i was found guilty. i was found guilty for both charges but since the charges were expunged and now say "dismissed" next to them would i still have to mention this on applications?

really confused at the moment. i dont want employers to think im lying, but i also dont want to mention anything if i don't need to.

im sure there are millions of people out there who have had similiar charges in the past and have jobs now.

They are technically considered convictions so, if you want to answer truthfully, you would say "yes" and then explain what they were for.

Depending on the type of job, the employer may or may not care (are you going to be applying for some job that involves driving)?

If you're in CA, VC 23103 is reckless driving and VC 23140 is a minor under the influence of alcohol, while driving.

Remember, these may show up in a routine background check and if you didn't fully disclose them and they are found, who knows what will happen.

I'm going to go out on a limb and say these were probably expunged because you were a minor (juvenile) at the time and now that you're over 18, you requested they be expunged so you can start with a "clean slate." I'm not judging or anything like that, but just stating what conclusions these lead me to (and may lead an employer to).

You can say that you were not convicted of a vehicle code misdemeanor or infraction as long the final disposition is dismissed. In other words exponent allows you to say you have never been convicted

Most employers are just interested in felony convictions and theft offenses not driving infractions. If they were dismissed I would not mention them unless you are applying for a driving job. Then you should. Read what they ask for and answer accordingly. If they ask were you convicted then you can say no, because they were dismissed. If they ask about a felony record, you can say so, because it was a misdemeanor.
