Question About A Paralegals Work.?

Do paralegals HAVE to ever appear in court? Is it possiable to just do the "paperwork" (such as look up old cases, investigate, and all that?) I have looked all over the internet, and I haven't really been able to find the answer. If the answer would vary by state I live in West Virginia.

The only way that I can think of is if the paralegal was already a lawyer, Paralegals to not represent a client the lawyer does, I have never heard of a paralegal appearing in court other than as a team member but to address the court No. Does this answer your question. |

In my last job, as a paralegal with the child support enforcement division in Indiana, I prepared all the the documents for the attorneys. I would then accompany the assigned attorney to the court hearings and frequently, the judge (for the record) would call me to the stand to testify about the documents and how they were prepared. However, only the attorney could actually represent the State in court. I thought the whole process was very interesting and I enjoyed this job very much. Hope this helps. |

In my firm paralegals do not accompany attorneys to hearings. It is possible for an attorney to ask a paralegal to attend, I just have never seen that. My job is merely research and writing, drafting pleadings, tracking cases, etc... |

Paralegals are not permitted to "appear" in court which would constitute the unauthorized practice of law. Only licensed attorneys may represent clients in court. If your question merely refers to accompanying the attorney and assisting at trial, that depends on the attorney. And the paralegal. Some attorneys do rely very heavily on their paralegals who assist during trial. |
