Question On Workers Comp.?

I'm totally lost at how to handle my situation. I was held in a gun point robbery at the place i was working at. I'm suffering post tramatic symptoms like depression, unable to sleep, nervous all the time. I was also forced to quit my job. There's much more to it. Do you think i have a case for workers comp.?

Worker's compensation cases vary from state to state. Unfortunately, as most posters they never say where they are from. The fact that you quit has nothing to do with the fact you would be unable to receive WC. Although WC claims are approved for injuries sustained on the job (even off the work premises if job related) this does not mean you would not be eligible. PTS is recognized by WC has long as you have documented proof from a psychiatrist or psychologist. In more recent case rulings people are now collecting WC due to horrible managers causing them undue stress. In your particular situation the situation was much graver. Again, do not apply unless you have medical documentation of your condition. In the event you are denied WC you may be eligible for disability benefits, but again you MUST have medical proof to substantiate your mental condition and it has prevented you from returning to the workforce.

You'd have to have an evaluation by a doctor or mental health professional in order to have a case. You might also qualify for unemployment. In both cases you may be denied in which case you should appeal the decision.

Yes! If you feel unable to deal with this, hire a w/c attorney to do the legwork for you. Attorney's fees are set by law in w/c and they collect when you get a settlement.

This does sound like there may be a worker's comp claim here as you are having these problems due to a work related incedent. It may be an issue that you quit your job...but I do recall having an employee quit due to stress, go on workers comp then try to file for unemployment. She did get the workers comp, but the unemployment was denied.
You'll need to check with someone familar with wc laws in your state.

By quitting your job and waiting until you obtain medical care ( if you have, at all) you have jeopardized your chances of collecting.
You can always check with your employer.

Here's how it is. Yes, what happened must have been terrifying, and it is regrettable.
But how long are you going to hide behind this before you get on with your life?? The longer you are out, the harder it's going to be.

Workers comp pays wages to employees who are injured and cant work. You must be out something like 10 work days to start recieving a check.

For a cash settlement you must have a permanent disability rating given by a doctor.

I dont really think you have a case but you should call a lawyer.

i live in NC and i was involved in an armed robbery and unless a person has experienced this they would have no clue the repercussions. i have been out for 4 months and am on WC but at this point i cannot return to work to chance that horrible experience would reoccur. i have been diagnosed with severe PTSD. WC has been helpful and i also have been seeing 2 doctors. this is something that i would definitely look into, as i believe an incident can be reported for up to a couple of years here in NC
