Question about Employee abusing work hour system...California Labor Law Question?

I am a franchisee owner and when I am not present at my business (mostly during the night shift), my employees would purposely work slower in order to get paid for longer hours. They would usually clock in at their usual time, but would clock out an hour to an hour and a half later if I am not there. Is there a law that says that I cannot pay them past a certain time? No. If you have set a precedent by paying you will need to have a memo stating that there will no longer be authorized OT. Then you have to enforce it equally. New employees may not be a bad idea either.

Sorry, you have to pay them. What you need to do is to set a realistic time for them to be done.( I did this by actually working the shift to see how long it took me.) Let them know that if they cannot get their work done by that time, that you will find people that can. Just make sure you are being fair, Like take into consideration that some nights will be busier than others, and that some workers do a more thorough job, which takes longer.

shorter hours and more relaxed condition could produce a better result if you dont get greedy like they are

Employees must be paid the time that they work; however, you can institute a policy which states that no OT past, say 30 minutes/night will be paid without your advance approval. Provide a mechanism (written approval on timesheet, documented cell call, whatever) for the approval to be requested.

Make sure every employee receives a copy of the new policy and signs a document showing that they received it and agree to abide by it. Congratulations - you are now protected against greedy employees.

BTW, you could always replace them. There are so many questioners on YA looking for jobs it can't be too difficult.
