I have worked for my employer for 15 years. I am a shipping clerk. My immediate supervisor is the shipping manager. There only the 2 of us that do shipping and we must NEVER be off at the same time. Last year I booked 2 days holiday for this August to ensure I could go to my sisters wedding. Within the last fortnight my supervisor has booked off 1 week's holiday which clashes with my 2 days. The Monday, Tuesday and Wednesday are covered but we will both be off on the Thursday and Friday. This has been pointed out to him by a colleague but the supervisor’s attitude is it's my hard luck. How do I stand?

I would advise you to contact you local CAB and then ACAS. Employment law is very complex and the first port of call would usually be usually negotiation. You may need to write a grievance letter. You should give your employer 28 days to respond, so you should get this done as a matter of priority. You should plan a meeting with your employer (Not the supervisor, but your proper boss) following the grievance letter and then be prepared to appeal, if the outcome is unsatisfactory for you. If it has to go to tribunal, there is a very strict time limit. (three months) Have a look at the website below. You should find some helpful stuff on there. As far as I am aware a company has no right to cancel your holiday once booked – but they can if its TOIL (time of in lieu). So if you booked your holiday before him and it has been officially signed off then its not your problem its his – just because he is ‘above’ you in the chain of command it doesn’t mean he can walk all over you.
He doesn’t sound like a great guy so when you stand your ground expect him to bite back. If it gets too bad speak to HR or the overall manager to get it sorted out – please don’t back down and let the bully win as next time it will be worse |

In any company, they have every right to dictate when you may or may not take holiday dependent on the needs of the business - either because they're too busy, or because, as in your case, their policy is to only have one person off at a time so that things are covered
Even though your holiday has been approved already, there's actually no legal requirement to say that they cannot now revoke their approval.
I agree it's grossly unfair - not just because you asked first, but also because when it's an event as important as your sister's wedding then of course you want (need) to be there. Therefore if your employer had any shred of moral decency, they'd let you take your holiday. But it's just that there's no law to help you out.
I would take it to your supervisor's manager and explain how unfair it is.
Also, I don't really know anything about your industry, but in many industries people aren't so busy in August anyway. In my job, I have very little to do because my role covers the whole of Europe and all Europeans go on holiday for the whole of August. Many companies could definitely manage for only two days with no-one in. Point this out and see if it gets you anywhere. |

I think you should write a letter of complaint with your family to the supervisores, and they should understand, i am only 14, but you sjhould protest about saying it's not fair. I did when my Dad's work place, Butler and Tanner, shut down. I held the sign saying: "Are you pleased with yourself Dolan?"

Is your time off in writing and dated. Was it signed by your supervisor. If so you should have preference for the time off as you have proof you applied first. |

If you can prove you booked them off first, then you're in the right. Go see someone in Personnel, or your manager's manager. If you don't have proof, then your manager is going to probably win this one. Bosses usually do. |

Most companies allow for them to cancel your holidays - but they usually need to compensate you. Speak to your HR department or your managers boss. This is grossly unfair, but it might be within the company's rules... |
