I have worked for a Tennessee company for the last eight years. They recently informed me they were eliminating my position ( after having it for 30+ years. ) Can they legally rehire someone else to do the same tasks I did at a smaller salary, and just call the position something else.?

At-will employment -- they can terminate anyone for any reason or no reason at all. Job categories and positions are eliminated all the time. There are no more PBX operators, elevator operators, or dozens of other jobs any more.
The one thing they cannot legally do is terminate you then you replace you with a foreign worker on an employment visa. Plenty of companies are doing this! It is, however, fraud. The company has to prove there are no qualified citizens available for the job in order to get the visa for the foreign worker. If they lay off someone doing the work satisfactorily (and if you kept the job for years, that's evidence your work was satisfactory), then bring in a foreign worker, even if the change the title, as long as the job is substantially similar, you can sue for discrimination based on national origin. You can also file a complaint with the US Dept of Labor alleging fraud in the company's obtaining of labor certification so that they could replace a citizen with a cheaper foreign worker. |

Legal, unless you can prove it was because of your age if you are over 40 - then EEOC might be able to help. If they terminated everyone over 40 and nobody under, and brought in all younger people, you might have a case, but if it was just you, unfortunately you're probably out of luck. Companies that need to save money often do this in order to survive. |

This is really common. They can probably get 3 recent grads for what they are paying you. I have no clue on the legality of it. It is a really shitty thing. |
