I had missed a day of work for my son being sick, no other options, and 2 days for me having a severe ear infection. This happened all in one month and I just started this job only 3 months ago. Just a stroke of bad luck. Anyways my boss called me at home the day I was out for me and asked me what was going on if I liked my job or not? I told her I had a dr's note I am not faking I am sick. She never ONCE told me over the phone I was getting a verbal attendnce warning ever. I came back to work to find I had a final written warning all of a sudden like I had had previous warnings in the past? What is that about?

Unless you have an employment contract, you are considered an at-will employee. In other words, you have a job so long as the company wants to keep you. I would make sure you dot your i's and cross your t's by ensuring that you take a doctor's note in to your boss and request that it be placed in your employment file. I would also ask the boss if he/she would prefer that I come to work ill and if she says, "yes", then do it. When other people start complaining that you are spreading germs ad making them ill, she might change her tune. As long as you have a doctor's note (and I would always keep copies of everything -- even ask for copies of the information in your employment file) you could have some legal recourse. As a general rule, though, at will employees are at the mercy of their employers. Good Luck.
Oh were you given a manual by your employer? Larger companies publish rules and regulations of employment and copies of the policies are given to employees at the time of employment and generally with written warnings (a copy of the portion of the policy that applies to the reason for issuing the warning). These can help or hurt but generally if you have a righteous reason, these warnings leave some room for negotiation. |

What that's about is that they will fire you if you have another absence any time soon. They aren't saying you are faking. But they are a business and need their employees at work when they are scheduled, and if you can't be, they can and will replace you.

Three days in 3 months is alot.
I don't think you should have missed work with a silly ear infection...I don't care how bad it is, that isn't a reason to miss work...strep throat maybe, but not an ear infection.
If you miss work every time you are not 100%, then you'll be missing work alot. Alot of people have to go to work when they don't feel well...that is, IF you want to keep your job.
No company is required to offer you a verbal warning, she just could have fired you on the spot if she wanted. |
