My husband has been a firefighter for approx. 10 years. He has a drinking problem and over the past year or so, has been showing up at work inebriated more and more. They never let him go out on a call, let him sleep it off and then work (he works 24 hr shifts anyway). The reason they fired him was over a verbal confrontation (while sober) with a superior.
My question is...someone told my husband that if he "admits" he has a drinking problem, they cannot fire him. They have to take him back and get him help (which he would never take seriously). Now he's thinking about 'fighting it'.
Just to clarify...as much as I love him, I do not think he should be taken back. They should have fired him long before that. I am just wondering if this claim has anything behind it.

The contract under which your husband works for the Fire Department undoubtedly has a protective clause for the protection of the Fire District or city. It's pretty standard because of the important responsibilities that a Fire Department carries for the political subdivision they are charged to protect, and serve.
Essentially, the Fire Department has the right to hire and fire, to maintain or administer discipline for the most efficient and proficient operation of the Department.
Larger fire departments may have counseling services and support available for alcoholism/substance abuse.
His verbal confrontation is most likely seen as "insubordination."
Alone, it might not be a problem, but given the rest of your husband's problems, the department may be justified.
Have him read his contract, or talk with his Union Steward. |
