Recently I was asked to resign from my job. Well, my boss told me he would mail me my last paycheck which is a

full 2 week check for over 900$. Well, it has been 2 weeks since this happened and I have still not received my check in the mail. I have tried calling him several times and he will not answer or return my calls. What can I do about this? And who all can I file a complaint with? Not to mention that afterwards I started hearing vicious rumors about me coming from my ex place of employment. Isn't that slander? What and who can I complain to about that? I don't appreciate my name being drug in the dirt from all of his employees that should not even know about the situation. Please HELP! I can't find good answers anywhere! Sincerely, Jen S

file your wage complaint and compaint about your ex boss with the labor commissioner. And contact the BBB (better business bureau) about the company's conduct.

File with the Department of Labor in your area. Send a certified letter to your place of employment, making it clear that you will not stand for any false information being provided about you to current employees... It will at least cover you for future issues should they arise, normally this will be enough to caution management that people are providing you information about what they say and in most cases will cause them to stop... THEN MOVE ON... Nothing good comes from dwelling in past. Rumors are simply rumors and mean nothing to anyone that truly knows you. Use those people as your references.

1. Get your money first.

Call the Dept of Labor in your state.
Send your boss a certified letter, return receipt requested outlining the hours he owes your for.

Legally you boss needed to mail you your check no later than your regularly scheduled payday. And in some state's even faster.

Then, after you get your check, get someone to do a reference check and document what is said. If they are saying bad things and the things are not true, nor documented in your employee file, take your reference and get a lawyer to sue.

But get your paycheck first.

As far as the unpaid wages, most states have an agency that handles that. It is usually part of the state's Department of Labor. They should have a form for you to file. Then they contact the employer. There is a big fine if the employer does not respond to them.

As far as the slander, it is only slander if they are untrue, and there is no agency that enforces slander laws; you would have to sue. Also, to win, you would have to prove that the rumors are from them, and prove that the rumors are untrue, and prove that they said something untrue (as opposed to something that got twisted after it left them), and prove that you were harmed. Just hearing a rumor is not enough.

Contact a labor lawyer in your area. Most employers ask you to sign an exit review ... this spells out their legal rights as well as yours.

Before you ruin a reference, I would actually drive down to the business and ask to speak with your former supervisor and discuss it with them.

Don't believe the office gossip...again, you are an easy target because you aren't there anymore.

THEN if that doesn't get you results, file a complaint with the Labor Board.
