Can I request to my former companies HR to change the reason for leaving on my Record of Employment from quit to dismissal? Also can they change this if a mistake was made 3 months ago (they tell me I was fired but with no paper work or union meeting, yet they say I quit on original ROE to change this to terminated now has cost me EI claims, as well as an unlawful termination on there part since Iw as not given a letter or union stewart meeting)? Thanks

kapn I see where your coming from but you may have mis-read my question or mis-understood it, I am not trying to file a grievance now but report a problem with them changing my ROE around now and saying I asked them too when I did not after 3 months

If you are in the US, you are best off taking this up with the union. If you were a paying member of the union and did not have a steward present during your termination, it could actually be an unlawful termination. You could have action against both the union and the employer if you are in the US based on the US Supreme Court case NLRB v. Weingarten in 1975. |
