Redundancy / severance payment while on foreign assignment?

Redundancy / severance payment while on foreign assignment?

If someone is severed / made redundant while on a foreign assignment, ie the final working day ocurred within the foreign country, which should apply when calculating the payment package? - the foreign salary or - the pre-foreign assignment local salary

A company tried to apply the lower local salary by booking the person's flight to arrive home in the following month and saying that it was the foreign assignment that ended at month end and that the day within the next month was vacation time under local employment terms. Can they get away with this?

since this question was listed under US only i will answer assuming that is the case
(and yes i know what happens when you assume anything)....

in the US severance is not required by law and is addressed only by contract.

if you don't have a contract
or
the specific issue is not addressed in a contract
then
whatever the employer offers is legal (since they don't have to offer anything).
