SEARCHING STUDENTS AND BACKPACKS IN SCHOOL...? 10 pts...read/explain?

They asked to search me and my backpack because they said some teacher said i had something illegal in my backpack, but did not specify what it was. Can they tell you they have you on camera to get you to talk when really you don't? I know they didn't have me on camera because I didn't do anything illegal, just had a conversation that got over heard by some knowsy snitch who acts like he cares what's going on in my life. I told them I wanted to talk to my parents, and they didn't let me. They just called them. If I refused to let them search me, what would they do? Call the police and bring a k-9? If so what would their evidence be? or probible cause? One person's statment? One teacher saying a student has something illegal because he was ease dropping on their conversation, doesn't sound like enough or hard evidence to cause a search. And how would it harm or effect the health of others? They say if they think it will, they can search you legally. But what if you just say no, what can they do? Suspend you for just no coperating? And wouldn't a k-9 be an invasion on my privacy? I mean If I went to a court and told a judge I heard someone say they were going to sell weed, would the judge give a search warrant based on just that? It's redicilous I think! Isn't are backpack private property?

Yes, It is consititutional to lie to someone to get a confession...Regardless...If you give them consent...it's consent...You can challenge them...OK, Let me see the video...That will determine real quickly if the have you on camera...Probable cause is based on what is called credible evidence or statement...HOw to judge credibility is questionable...A K-9 dog is not an invasion of privacy...nomore than a metal detector or X-ray machine...If the dog signals a substance...That IS probable cause...Now the final thing is...If you are on School property...That is state or city property...and other laws...You have no expectation of privacy...This is that case with most government buildings and facilities...Because those facilities are NOT your private property...But there should normally be a disclaimer in the form a sign...Which states so...But is not always needed...The most they could probably do is ask you to leave the property and suspend you from school...

If my kids were in public school today I would want all students and teachers search for the safety of my kids.

Trust me if the school had called wanting to search my son, I would say go for it.

The law for schools and the laws outside of school are a little different.. YES, they can search you..YES, you can say no until a parent gets there, YES, they can make you wait.. YES, they can suspend you just not coperating.. they may not say it is for that but that would be the reason..

ok I used to go to public schools. But I am home schooled now. But in my old school we had cops. yeah thats how bad it was, But one cop tried to grab my purse at lunch. I grabbed my purse. I said what are you doing. And he said that he wanted to check it. I told him that he can leave my **** alone. so they called my mom. My mom told them that they cant check my purse unless they see something with their own eyes. And she said that If It happens again then they wish they wouldn't. so just talk to your parents. so you wont have to go to court or anything.

I think that the laws in schools are different and that they don't need probable cause to search you, and definitely they can search your locker without cause or consent. But I think any punishment you get if they found something would apply only to the school, like being suspended or expelled. You couldn't be prosecuted criminally if the search was not legal (from a police point of view). I would suggest refusing to allow them to search you, especially if you have something illegal on you. I think you would at least have a better case against the school if they searched you against your will. If you had drugs and voluntarily let them search you they could probably call the police, and the police would have probable cause (or the actual evidence). If you have drugs and they tell you they are bringing in a K-9, maybe it would be best to just walk out of the school, go a few blocks away where no one can see you, and dump the drugs in a sewer, toss them in a river, etc. Just be sure to get rid of any residue and drug paraphernalia also. Then go back to school, and if they try anything, there won't be any evidence.

yeah it is illegal but they do it with permission from the state, county, and police department.
they will bring cops in its happened to me ):
