lam working in a software firm as technical associate, our team includes five members, we r in hardware troubleshooting section. last month our company divided into two. So we r in the new section of the parent company. From last month we r not getting salary (January, February). Company is saying there is some transaction problem when it divided. But we came to know that their excuses r meaningless. What we ll do, is there any legal move needed? or what type of legal action we have to take? This is a problem affecting lot of members in the section. Please give me solution. (legal as well as any other)

The obvious solution is to look for another job. There is no point working in a company that doesnt give you salary for two months!
The only other thing you can do is to wait or file a case in the court. Either way there are no guarantees. A court case can/will take years to yeild any resulot in such matters.
So look for a job in a better company!! |

That is illegal - call the state labor board. They will come down pretty hard.
Or contact your own attorney. Two months without pay...some people live paycheck to paycheck...how are they faring.
I worked at a company that tried to pull that crap a long time ago. The former company took us back and paid us retoractive plus a bonus for putting up with the bs. |

I think that there is some kind of law that states that your employer must pay you on a given day. So, if you're not getting paid, and this is now going on for 2 months, you need to talk to someone about it. The company may require that you go through an arbitrator to resolve the issue, however I'd feel more comfortable in getting my own lawyer. Least you know that they're on your side.
What is might take to get their attention is for the hardware department, as a whole, to threaten legal action if they do not correct this problem. Make sure that you give them an achievable deadline, as well as following through with your actions.
One would think that worse case sceniro they could write you an old fashioned check... kinda like how they pay their suppliers, vendors and other bills... ?!!! |
