Salary reduction with employee's acceptance. Legal way?

1. My salary fixed component was $55000. Variable differ from month to month.
2. Recently (1week) my employer changed it to $42000 as fixed and $13000 as variable. Variable will get paid on quaterly basis only after company's overall perfermonance. These overall perfroamance nos are communicated to me verbally as well as in written form.
3. Now Chances of getting of this variable part is almost zero. (So far they never paid variable part)
4. Employer has issued such changed offer letter and immediately implemented the change in salary even though I have not accepted the revised offer letter.
5. With out my acceptance of this new offer, now my pay stub amount has been reduced by 20%.
6. Please advise: Can emploer take and implement such change with out my acceptance? Can I contest against this legally?

Why can't you just be happy you still have a job?
If you contest it, you could be fired.
We're in a recession and millions of people have lost their job and many more will continue to lose their jobs, you're lucky to have one. |

The only way this would be illegal is if it was done to only a certain group that would fall under The Civil Rights Act of 1968 known as Title VII. It appears your company is doing a very admirable thing. Rather than lay-off's (another word for terminate) any employees they are looking for ways to keep the staff. |

Contact your state dept. of labor-wage and hour division.
You should be able to talk to them without starting anything.
An employer should give a reasonable time for the employees to review the offer and make a counter proposal before implementation.
I do not think an employer can legally reduce an employees wages while in their current position. |
