I worked in singapore. My ex-employer terminated me on 3rd January 2009.But they wrote down the last date of my service is 29 December 2008 on the termination letter. Then now they send me email to ask me for pay back the AWS or bonus which they said under the company's policy, i must pay back the bonus that i got on 18 December 2008 as i didn't fulfill the service until the end of the december.But they didn't give a limit date or time for me, i wondering is it actually i no need to pay back?since is they terminate me not i choose to not fulfill the service until the end of the december. Anyone who is familiar with the singapore law or any lawyer friend here can give me a help?Thanks for advanced.

Thanks for Pilot's answer. But i would like to add on is they said under their company's policy, i have to give back since i didn't fulfil the end of the december, so is not eligible to get it.Anyone know about this kind of policy?or any lawyer friend can help or anyone who experienced for this kind of problem..thanks

They can choose to terminate you on the date before 30 as they wish,so you'll return it back to them. It sounds unreasonable since they're the one who stopped you to not be able to work until the end of December, not you resign by yourself. They can be tricky anytime to just lie to you that the actual date that they terminated you is 29th but in fact,it might be 1st of Jan? Since you got the letter on 3rd of Jan,not 29th Dec. So I think that it is unfair if you really need to pay back. But I am not sure about this. If anybody knows,share it with us ^^ |

If you received the bonus then you earned it and don't need to pay it back. A bonus is different from an advance which you would have to pay back. |

What does your contract say.........do you have to be employed on Jan 1 to get last years bonus........if that's true..........your out.....that's why they canned you on the 30th..........sorry............. |
