Should I sue?

I was hurt at my former job, and the contractor I work for doesn't carry workers comp and refuses to pay hospital bills. Do I have ground to stand on in court?

In California, the failure to have workers' compensation means that the employer cannot use the "workers' compensation is the exclusive remedy" as a defense so you would be entitled to sue.

Verify with the labor department in your state, but I think it's universal in most states.

Get an attorney ASAP - if you can get a consultation with an attorney who specializes in workers' compensation, he/she can tell you whether this defense has been waived.

First you need to contact the Workers Compensation court in your state and see if his failure to carry the WC insurance is illegal. They should be able to provide you with a remedy for the situation.
