i bought a box of mac n cheese and opened it to cook it about a week after i bought it and their was maggots crawling in the box, and some were dead in the box like shells so i know they been in the box for awhile. it was very nasty and im not sure what to do im mad that it happened to me but i don't want to over react.

don't get a lawyer, the first thing the lawyer will do is ask if you tried to contact them first.
call the company on the box most of the time they have a phone number or something on the box. tell them the situation, if you have your sales receipt offer to send that and the box to them. They will probably reimburse you for it and more.
Americans are so quick to sue. But stop for a second. Yes it happened, but were you hurt? No, you didn't actually eat it. It was a product that you were suppose to cook first then eat. Not a bag of chips where you reached in and pulled out a handle full and dumped it in your mouth before you realized their were maggots. Yes it is disgusting, but you are best off going to the company and dealing with them. There is no point in suing. People sue for attention and punitive damages when they were injured.
Everyone thinks it is so quick and easy to make money after that lady sued McDonald's and won a huge lawsuit after she was burned for spilling hot coffee. But there was a lot more to that case. Massive burns, she attempted to get reimbursed from McDonald's for her medical bills first. Other lawsuits about the same situation that McDonald's had settled and refused to settle hers. After the other lawsuits it was proven McDonald's had kept their coffee 10 degrees hotter than every other restaurant and knew it was hotter and knew it had burned people and refused to pay for her medical bills, which was all she sued for. Point me telling you this is, its a rare rare case when people win a lot of money from product cases. It was the fact that the lady tried settling with McDonald's for a reasonable amount, her medical bills, and was refused and that they were aware of the problem is why she got money.
The mac and cheese company in your case, i can almost guarantee is not aware of your situation. Otherwise they would be shut down by health violations. You must first try to work through it with them. Most likely they will reimburse you the cost of the box and be done, and that is all a court would give you as you are not injured by anything. |

Send it to the maker of the mac & cheese. You might get some free boxes of the stuff out of them, if you are still interested in ever eating their product again.
A lawyer isn't going to do anything for you. If you had eaten the maggots, gotten sick, and incurred medical expenses then maybe get a lawyer. Right now all it will take to make you "whole" from a legal standpoint is to reimburse you for the cost of the product. I'm sure you can get the store where you purchased it to do that.
And if you already threw it away, nothing you can do. |

Coming from a person who works for a major consumer product company if you call them they WILL refund you the money and more if you ask. Its worth it to them to make there customers happy and will often send you stuff free of charge. I once called about an old broken toy and they sent me a new one, no questions asked. Only get a lawyer after you try to resolve an issue with a company. Any lawyer will tell you to do that I am sure. |
