Should you be paid the same for the same job?
Find answers to your legal question.

Should you be paid the same for the same job?

My friend has been working for a company for several years and someone new has just been hired for exactly the same job but is getting paid alot more. But my friend also has alot more responsibility than the new guy like he is a key holder and on call when the manager is away. So is he entitled to at least the same wage?

Unless you are in a Union Office your are entitled to what ever the boss says....if you don't like it...move on.

No, he's entitled to whatever his contract says he's entitled to (although if he's good at his job and the firm wants to keep him, a word in the ear of a suitably senior individual might just get a salary increase...).

This happens to a lot of people I'm afraid and is unfair. I used to be a key holder, in charge of a tool stores, clean toilets, organise goods inward and dispatch, unload vehicles, order stationery and loo rolls etc. and was on stand by emergency out of work hours. When it came to stock taking every three months, all other office employees were paid overtime, I was paid nothing and told it was in my contract. If I did not like it then leave and find another job.
How demoralising is that?
When I was in a head on car accident I had a doctor's note for one month. I was told that if I valued my job I would return to work after two weeks. Although I was employed for less than two years I did not have a case. He eventually sacked me for a feeble excuse.
You can understand why people don't respect their employers, and in your friend's case, it's no different. His or her employer is being disrespectful.

YES, tell him to go talk to his boss and update the contract they are on was it seams unfair

she is entitled to the same but how does she know that shes not on the same? some companies discipline members of staff for discussing their salaries with each other for that exact reason. It could go one of 2 ways, she can discuss it with someone and get a pay rise, or she could discuss it with someone and get in trouble!

I've seen that before. There was this guy that had been working on a construction site back in the 1990s and he was making 9 bucks per hour and had been doing the job over a year. Then my friend went and got the same job as him and was getting paid 12.75 per hour (this on top of the fact that my friend was barely out of high school and this other guy was in his mid 20s.) When the 9 dollar an hour guy found out about it, he quit because he thought it was unfair. I dont know what happened to him after that.

Anyway...if they are paying the new guy more than the old ones, they must not think much of your friend and I'm sure if your friend confronts the manager, they will be sure to "let him go" as these companies love to flex their power around.

Or it could just be that the manager has no idea what your friend is making and would be happy to increase their salary.

as long as you do your job in a proficient manner it should be rewarded the same way as anyone else ... equality is fairness , unfortunately some people/companies don't see it the same way.

no not necessarily - it depends what it says in your contract of employment. However, if your friend is female and the new employee is male and she believes she is being discriminated against because she is female, then there could be grounds for an equal pay claim under the Equal Pay Act...advise your friend to speak to a trade union representative (if there is one!) or contact the Equal Opportunities Commission, Citizens Advice Bureau.
