Sick Pay Question - Does this sound strange to you?

My husband has been working with a large corporation for almost a year now. He has about 31 hours of sick time accumulated. He was sent home sick halfway through a shift & was out the next day as well. Upon returning to work, he was told that he could not use his sick pay because he has to be out for 2 consecutive days & even then, they only pay you for the second day. They never pay you for the first day you're out. I'd never heard of this & was wondering if it's legal?

As long as all employees at a level are treated the same, yes. Sick pay (at least in the US) is employer specific as far as amount allowed and usages. I have heard of that specific case from friends. Seems weird to me as well; seems to encourage people to stay home longer or not go at all.

Yes, sick time is at the discretion of the employer. They don't even need to offer paid sick time.
I had an employer once whose rule was that you needed to be out 3 consecutive days before you could start using paid sick time. All the long-time employees had hundreds of hours available because nobody would be out that long without being on disability.
It's just one of those "benefits" that sound good, but are made difficult to use - like frequent flyer miles!

Actually legal. Would be illegal if one of the two occurs:

1 - They have done this only to your husband and to no other employee; and/or

2 - There is a policy and procedure booklet that dictates the policy to be much different.

Unfortunately, benefits are just that -- A benefit. The majority of states do not require an employer even offer vacation or sick time, or personal days.

Hm...that's weird. No, that's really weird. I would assume it's legal, honestly. Companies don't have to offer sick pay at all, so when they do it's their choice. I imagine it's not guided by any legalities except the you can't fire someone for being sick thing.

Hey Summeraine, if he's union then then they have a problem. Hubby can call the labor board on them. But if he's not union then it's whatever their own policy is written to be. Best thing to do is look at the company hand book and check it out. Good luck.

If it is LEGALLY in the company policy, it is legal. Here my husband was let off by a DR for 3 days due to the company he works for making a mistake and endangering his health (CO2 poisoning). They paid the DR but refused to pay my husband for lost work claiming workman's comp..you have to be off 4days before they pay. HECK..he should've taken an extra day!!!

I had this in a previous job, I always took 3 days after i found out i wouldnt be paid for just 1.

yes its a loophole, any good employer would pay you. the nasty ones dont.

companys write there own policies, and sometimes have o ryhm or reason.....sick days are a beneifit, not really being covered by any other means,except company policy......

He should check the personnel manual at work, or his contract if he has one. Or he should speak with the HR Manager, and ask if their sick policy is in writing.

That does not sound correct. I would check with HR under the guise of making sure you understand the policy.
